Terms and Conditions 

Welcome to the Civil and Surveying Institute website civilandsurveying.com, including the subdomain https://spot.civilandsurveyinginstitute.com (the “Site”), owned and operated by the Institute of Surveying and Civil Design Training Pty Ltd (referred to as “us,” “we,” or “our”). These terms and conditions (“Terms”), along with our Privacy Policy and other documents referred to within these Terms, govern your use of the Site and the supply of any products or services ordered by you through the Site.

By browsing, accessing, using the Site, or placing an order (“Order”), you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site. We may modify these Terms from time to time, and the revised Terms will be posted on the Site. Your continued use of the Site after the revised Terms have been posted constitutes your acceptance of the revised Terms.

1. Access to and Use of the Site

1.1 To place Orders using an Account, you must be at least 18 years old and have the capacity to enter into a legally binding agreement with us. If you are under 18, you may only place an Order with the involvement of a parent or guardian – we do not sell products for purchase by children.

1.2 You must not use the Site for any unlawful purpose or in any way that is prohibited by these Terms or applicable law.

1.3 We reserve the right to refuse service or access to the Site to anyone for any reason at any time.

1.4 You are responsible for maintaining the confidentiality of your login details and password, and you agree to accept responsibility for all activities that occur under your account.

2. Purchases

2.1 The Site offers online (instructor-led online courses, self-paced online courses) and offline training courses (public training, in-house training), event tickets related to the organisation, merchandise, and certification exams.

2.2 All prices quoted on the Site are in Australian dollars (AUD) and are exclusive of Goods and Services Tax (GST).

2.3 Payment must be made at the time of purchase, and we accept payment through the payment methods displayed on the Site. We reserve the right to change our payment methods at any time.

2.4 We reserve the right to change our prices and to add, modify, or remove any special offers or promotions without notice.

3. Intellectual Property

3.1 All content on the Site, including but not limited to text, graphics, logos, images, and software, is our property or the property of our licensors and is protected by Australian and international copyright laws.

3.2 You may not copy, distribute, modify, transmit, or use any of the content on the Site for commercial purposes without our prior written consent.

4. Limitation of Liability

4.1 We do not guarantee that the Site will be error-free, uninterrupted, or free from viruses or other harmful components.

4.2 To the fullest extent permitted by law, we disclaim all liability for any loss, damage, or expense suffered by you or any third party as a result of your use of the Site, including but not limited to any direct, indirect, incidental, consequential, or punitive damages.

5. Cancellation 

5.1 Please note that instructor-led online courses may occasionally be cancelled or rescheduled if trainers’ availabilities change. If a change to a course occurs and you are unable to attend the new time, we will transfer your registration to the next available course.

5.2 All courses are non-refundable. However, if you are unable to attend a course due to extenuating circumstances, please contact us and we will consider transferring your registration to the next available course.

5.3 In regard to physical products such as those sold in the merchandise catalogue, we reserve the right to terminate a Contract if the product is not available for any reason. We will notify you if this is the case and return any payment that you have made. We will refund any money received from you using the same method originally used by you to pay for the product. If the refund transaction fails, we will advise you of this and make arrangements to process the refund via a different method.

5.4 All event tickets are non-refundable.

6. Indemnification

6.1 You agree to indemnify, defend, and hold harmless the Institute of Surveying and Civil Design Training Pty Ltd and its directors, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees and costs) arising out of or related to (a) your use of the Site; (b) your breach of this Privacy Policy or the Terms of Use; (c) your violation of any applicable law, regulation, or third-party right, including without limitation any intellectual property or privacy right; or (d) any content or information that you submit, post, or transmit through the Site. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defence of such claim.

7. Governing Law

7.1 These Terms and any dispute arising out of or in connection with these Terms or the use of the Site will be governed by and construed in accordance with the laws of the State of New South Wales, Australia.

8. Software Licence for Training Use Only

8.1 The 12d Model software is copyrighted by 12d Model and/or its suppliers, and its use is governed by the accompanying end-user Licence Agreement. Installation requires agreement to the terms.

8.2 It is expressly prohibited by law to reproduce or redistribute the software in any way that does not comply with the Licence Agreement. You may be held legally responsible for any copyright infringement resulting from your failure to adhere to the terms of the Agreement.

8.3 Please note that the 12d Model student licence provided for download through the Civil and Surveying Institute is not for commercial use. The licence has been granted to allow you to complete your training course through the Civil and Surveying Institute. This licence will remain active during the time of training and may last, depending on the longevity of your training with us, for up to six months, at which point it will expire.

8.4 Please complete your training within the recommended period as you will only have access to the software during your training. Failure to complete the training within the specified period may require you to re-enrol or purchase a 12d Model licence, depending on your student membership level and recommended training/course completion time.

8.5. Requesting a Software Licence Extension for Self-Paced Online Training (SPOT): In order to extend the software licence access provided by the Civil and Surveying Institute for self-paced online courses, trainees must have a valid reason and apply for a leave of absence. This will allow the software extension to be granted when the trainee returns. A leave of absence may only be granted to trainee members who have completed all payments and is at the discretion of the Civil and Surveying Institute. Trainees must inform us in advance to pause the software licence during the leave of absence.

A leave of absence for a software licence extension may be granted for a maximum of three months, depending on the length of the course and the trainee’s membership level. If a trainee takes a leave of absence without informing us, their software licence will continue to run, and no extension will be granted.
